DMCA Policy

VivaStreet (“the Site”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond promptly to claims of copyright infringement committed using the Site.

1. Reporting copyright infringement

If you believe that content on the Site infringes your copyright, please submit a written notification to our designated DMCA agent at:

2. What to include in your notice

Your DMCA takedown notice must include the following information:

  1. A physical or electronic signature of the copyright owner or a person authorised to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material that is claimed to be infringing, including the specific URL(s) where the material appears on the Site
  4. Your contact information, including name, address, telephone number, and email address
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorised to act on behalf of the owner

3. How we respond

Upon receiving a valid DMCA notice, we will:

  • Review the notice for completeness and validity
  • Remove or disable access to the allegedly infringing material promptly
  • Make a reasonable effort to notify the party responsible for the content, if applicable
  • Document the notice for our records

4. Counter-notification

If you believe that material was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to dmca@vivastreet.llc containing:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and the location where it appeared before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts in your district

Upon receiving a valid counter-notification, we may restore the removed material within 10–14 business days unless the copyright owner files a court action.

5. Repeat infringers

In accordance with the DMCA, we will terminate access for users who are determined to be repeat infringers in appropriate circumstances.

6. Good faith

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and legal fees.

7. Third-party content

VivaStreet aggregates content from third-party sources. While we respond to all valid DMCA notices regarding content displayed on our Site, we encourage copyright owners to also contact the original source where the content was first published.
